Cruise fare increases: ship fuel, flights and passenger rights

Fuel surcharges ยท 20-day rule ยท flight costs ยท passenger protection

An unexpected cruise price increase can be worrying if you already booked with Costa or MSC. Italian package-travel rules do not allow organisers to increase an agreed fare simply because a new advertised price is higher. A valid review clause, an eligible change in cost, a clear calculation and timely notice are required. Flight fuel surcharges also deserve special attention when the flight was purchased with the cruise.

Key point: Article 39 of the Italian Tourism Code requires at least 20 days' notice of a permitted increase, and an increase above 8% of the full package price triggers specific cancellation rights. Costa has also published a special fuel-price guarantee for the cruise-only fare component on departures through 31 May 2027.

1. When is a post-booking price increase allowed?

Fuel costs may affect the fare only under the legal and contractual rules.

Article 39 allows revisions after a package-travel agreement has been concluded only where the contract expressly permits them and sets out the calculation method. The permitted causes are changes in passenger transport costs attributable to fuel or other energy sources, relevant third-party taxes or levies on services included in the package (such as port or airport fees), and exchange rates relevant to the package. The contract must also acknowledge the traveller's right to an appropriate price reduction when those qualifying costs fall.

This is completely different from the advertised price of an unsold cabin changing online. A lower promotional price on a new booking does not automatically alter an earlier booking, just as a higher online price does not automatically justify a surcharge. Keep your original confirmation, cost breakdown and the contractual conditions that applied when you booked.

2. The 20-day deadline

The deadline limits when notice can be given: it does not trigger an automatic increase.

The 20-day rule is a deadline for notifying a permitted increase, not an automatic re-pricing date. The organiser must explain the justification and calculation clearly on a durable medium, such as an email that you can retain. For a departure on 5 December 2026, the general deadline would be 15 November 2026. This illustration does not mean that an increase is actually due on that sailing.

MSC's terms effective from 1 September 2026 provide an additional contractual protection: the price becomes final from the twentieth day before departure, or from the date MSC receives the full balance if that happens earlier. Always check the terms applicable to your own booking rather than relying on someone else's experience.

3. Costa: fuel surcharge guarantee through 31 May 2027

Costa's official FAQ currently says that for sailings departing by 31 May 2027, Costa will not apply a fuel surcharge to the cruise fare component. This is a particular commercial guarantee that should be considered before assuming that a rising oil price will increase the ship portion of a booking. It does not automatically freeze the air-ticket component or unrelated charges.

The FAQ also refers to an extended guarantee for Neos charter airfares only for departures up to 30 September 2026; that past cut-off must not be applied to later sailings. Costa specifically explains that with flights operated by other airlines, the air-transport component follows the carrier's market tariffs and can change before or after confirmation. However, once an air-inclusive package has been concluded, any claimed adjustment must still be assessed under applicable package-travel rights and the contract, not simply against the airline's latest published prices.

Costa's contract terms distinguish ship fuel from aviation fuel, including sustainable aviation fuel (SAF), port and airport taxes, exchange rates and certain environmental emissions charges (ETS). The contractual version depends on the date of booking. Avoid applying a generic percentage circulating on social media to all Costa bookings.

4. MSC: port taxes and ship fuel

Taxes, transport and exchange rates are separate items: ask for the calculation.

In MSC's conditions effective from 1 September 2026, Article 3 specifically lists changes in embarkation or disembarkation taxes at ports and airports and changes in fuel costs for ship propulsion. The ship-fuel calculation refers to the WTI oil index and a contractual threshold of more than 0.33% movement. MSC must document the relevant change. The terms also expressly freeze the price when full payment has been received or from 20 days before departure, whichever happens first.

For a flight included in an MSC package, the air-transport cost is part of the overall package price. The revision clause checked in Article 3 does not separately specify an aviation-fuel adjustment equivalent to its ship-fuel clause. If a flight-related supplement is requested after confirmation, ask MSC to identify the precise contractual basis and show the calculation.

5. Air fuel: part of the package or a separate flight?

โœˆ๏ธ Flight included with the cruise

When the organiser sells a flight-and-cruise package, the package price and any proposed adjustment are subject to the protections of package-travel law and the applicable conditions. Check which part relates to ship fuel, airline transport, taxes or other costs. Costa's temporary ship-fuel guarantee should not be extended to airfares without confirmation.

๐ŸŽซ Independently purchased flight

A flight purchased directly from an airline as a separate ticket is generally governed by the carrier's fare conditions and the rules for air transport. The package-travel review provision does not automatically apply to a standalone airline ticket. Review the confirmed fare and what fees the airline's terms permit.

When adding flights later through Costa or MSC, check whether the airline component becomes part of the amended package or remains a separate service. That contractual distinction, rather than the sellerโ€™s brand alone, governs the relevant protections. A YQ/YR charge appearing on an airline ticket may represent carrier-imposed supplements, but its presence alone does not prove that a new payment can be demanded after booking. Ask for a comparison of the original amount, the proposed surcharge and the contractual explanation.

6. What happens above an 8% increase?

If the package increase exceeds 8%, you may be entitled to cancel without a fee.

When a permitted increase exceeds 8% of the total package price, the traveller can accept the change or cancel without cancellation fees under the applicable procedure. The percentage is calculated using the full package price, not just the fuel or air-ticket component. For example, 8% of a โ‚ฌ2,000 package is โ‚ฌ160: an increase of โ‚ฌ170 exceeds the threshold; โ‚ฌ150 does not. Smaller increases are not automatically lawful if contractual and statutory requirements have not been met.

MSC's September 2026 conditions state a 14-day period from notification for exercising this specific right. Costa's applicable booking terms should be checked for the required response period. Where qualifying underlying costs fall, package-travel law provides for a corresponding price decrease, subject to documented administrative charges in the cases allowed. A promotional reduction on a new booking is a separate matter.

7. What to do when you receive a surcharge notice

  1. Record the departure date and the date the notice was received.
  2. Keep the original contract, payment receipts and detailed price breakdown.
  3. Ask for written reasons, the relevant cost index and a calculation of the increase.
  4. For Costa departures through 31 May 2027, consult the current ship-fuel guarantee in Costa's official FAQ.
  5. For MSC, check when the full balance reached the organiser, as well as the 20-day deadline.
  6. If the increase is above 8%, check the cancellation options promptly. For a complex dispute, consider consumer-advice or legal assistance.

8. Frequently asked questions

Can Costa add a ship fuel charge for a 5 December 2026 departure?

Costa's published FAQ currently guarantees no fuel surcharge on the cruise fare component for departures through 31 May 2027. Airfares and other charges must be examined separately.

Does booking a year ahead fix the price permanently?

Not by itself. The original contract and any more favourable company guarantee govern whether a lawful adjustment remains possible.

Is airline fuel treated exactly like ship fuel?

No. Costa's contracts expressly address aviation fuel, while the specific MSC price-review clause checked refers to ship propulsion fuel and specified port and airport taxes. Request the precise contract wording for any air surcharge.

What if I have already paid MSC in full?

Under MSC's terms effective 1 September 2026, the price is no longer adjustable once the full balance has been received, if earlier than the 20-day cut-off. Verify the terms applying to your booking.

Do I receive a refund if the advertised fare falls?

A later discount on a new booking is different from a statutory reduction linked to specific underlying transport costs, taxes or exchange rates.

Can I cancel without penalty for any increase?

Not automatically. The specific right under these price-review rules applies when an increase exceeds 8% of the total package price, although other unlawful increases may still be challenged.
